Gregory P. Bazan Obtains Decision Dismissing Third Party Complaint
Gregory P. Bazan, Esq. recently obtained a decision granting a motion to dismiss a third party complaint. The matter centered on an underlying dispute between a general contractor and owner. Several subcontractors filed lawsuits against the general contractor’s surety company to recover on the labor and material payment bond for the project. The general contractor sought to consolidate all of the actions. Gregory P. Bazan and Jordan R. Pavlus successfully defeated the motion to consolidate. Afterward, the general contractor’s surety sought to bring the owner into the subcontractor actions via a third party complaint. Mr. Bazan obtained dismissal of the third party complaint by successfully arguing that it was precluded by the previous decision on the motion to consolidate.
